Terms of Service

Pivot House is an independent game studio. We build motion-first browser games — experiences that use your device's physical sensors as controllers, with no app store and no downloads.

These Terms of Service ("Terms") govern your access to and use of all Pivot House games, websites, and services, including pivothouse.io and any game hosted under our studio umbrella (collectively, the "Services").

By accessing or using our Services, you agree to be bound by these Terms. If you do not agree, do not use the Services.

You must be at least 13 years old to use the Services. If you are under 18, you represent that you have your parent or legal guardian's permission to use the Services and that they have read and agreed to these Terms on your behalf.

By using the Services, you represent and warrant that you meet these requirements and that all information you provide is accurate and truthful.

Some features of the Services require you to sign in using a third-party authentication provider (currently Google). By signing in, you agree to that provider's terms of service and privacy policy, in addition to these Terms.

You are responsible for maintaining the security of your account and for all activity that occurs under it. You agree to notify us immediately at hello@pivothouse.io if you suspect any unauthorized use of your account.

We reserve the right to suspend or terminate accounts that violate these Terms, engage in fraudulent activity, or abuse the Services.

You agree not to:

• Use any automated system, bot, script, or other tool to play games, claim rewards, or manipulate leaderboards or contest outcomes
• Interfere with or disrupt the integrity or performance of the Services
• Circumvent any technical measures we use to protect the Services
• Use the Services for any unlawful purpose or in violation of any applicable law or regulation
• Impersonate any person or entity or misrepresent your affiliation with any person or entity
• Attempt to gain unauthorized access to any portion of the Services or any systems or networks connected to the Services

Violation of these rules may result in immediate account termination and disqualification from any active contests or rewards programs.

From time to time, Pivot House may offer skill-based contests, bounties, or prize programs in connection with our games ("Contests"). Each Contest is subject to its own Official Rules, which will be published at the relevant URL (for example, pivothouse.io/tiltra/bounty).

Where Contest Rules exist, they are incorporated into these Terms by reference. In the event of any conflict between these Terms and Contest Rules, the Contest Rules govern with respect to that Contest.

General Contest conditions:

• All Contests are skill-based. No purchase is necessary to enter or win.
• Eligibility restrictions may apply, including age and geographic requirements. See individual Contest Rules.
• Winners may be required to provide verification of identity and eligibility before any prize is awarded.
• Prizes are non-transferable except where explicitly stated in Contest Rules.
• Pivot House reserves the right to cancel, suspend, or modify any Contest at any time for any reason, including suspected fraud or technical failure.
• All decisions by Pivot House regarding Contest outcomes are final.

Note: Specific prize amounts, eligibility criteria, verification procedures, and payment terms are defined in each Contest's Official Rules document. Always review the applicable Contest Rules before participating.

Our games may include advertising, including rewarded video advertisements that offer in-game benefits in exchange for viewing an ad. By choosing to interact with rewarded ads, you agree to the terms of the applicable ad network.

We are not responsible for the content of third-party advertisements displayed within the Services. If you encounter an advertisement you believe is inappropriate, please contact us at hello@pivothouse.io.

Some Services may offer optional paid content, such as unlockable items or features. All purchases are final and non-refundable unless required by applicable law.

Virtual items, currencies, and unlockables have no real-world monetary value and cannot be exchanged for cash or transferred between accounts.

All content, design, code, graphics, game mechanics, and other materials within the Services are the property of Pivot House or its licensors and are protected by applicable intellectual property laws.

You are granted a limited, non-exclusive, non-transferable, revocable license to access and use the Services for your personal, non-commercial enjoyment. You may not copy, modify, distribute, sell, or create derivative works based on any part of the Services without our prior written permission.

Your use of the Services is also governed by our Privacy Policy, available at pivothouse.io/privacy, which is incorporated into these Terms by reference. By using the Services, you consent to the collection and use of your information as described in the Privacy Policy.

By creating an account, you agree to receive transactional communications related to your account and the Services (such as account verification and contest notifications).

With your separate, explicit consent during account creation, we may also send you marketing communications about Pivot House games, updates, and news. You may opt out of marketing communications at any time by clicking the unsubscribe link in any marketing email or by contacting us at hello@pivothouse.io.

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

PIVOT HOUSE DOES NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

TO THE FULLEST EXTENT PERMITTED BY LAW, PIVOT HOUSE AND ITS OPERATOR SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICES, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

IN NO EVENT SHALL PIVOT HOUSE'S TOTAL LIABILITY TO YOU EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID PIVOT HOUSE IN THE TWELVE MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS ($100).

These Terms are governed by and construed in accordance with the laws of the State of New York, United States, without regard to its conflict of law principles. Any disputes arising out of or related to these Terms or the Services shall be resolved exclusively in the state or federal courts located in New York, New York.

We reserve the right to update or modify these Terms at any time. We will provide notice of material changes by updating the Effective Date at the top of this page and, where appropriate, by notifying you via the email address associated with your account.

Your continued use of the Services after any changes take effect constitutes your acceptance of the revised Terms.
